("Company," "we," "us," or "our") describes how and why we might collect, store, use, and/or share ("process") your information when you use our services ("Services"). By using our Services, or by accessing our website at https://pear.trade or any website of ours that links to this privacy notice, you are accepting and consenting to this Privacy Policy.

What information do we collect?

TL;DR Information you give us when you sign up and trade, plus automatic device and usage data. What you make public is up to you.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal information provided by you

The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include:

  • Your name
  • Your email
  • Your phone number
  • Social media usernames for any accounts you link to the Services
  • Financial information, including information you provide us about cryptocurrency wallets and payments
  • Information from social media accounts you use to log in to the Services
  • Trading activity and prediction market positions you choose to share publicly through our social features
  • Profile information you create on Pear, including display names, profile pictures, and bio information
  • Information about users you follow and users who follow you
  • Content you post or share through the Services, including comments, reactions, and shared predictions

Information automatically collected

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies and similar technologies.

How do we process your information?

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • Account creation and authentication — to create and log in to your account, and to keep your account in working order.
  • Service delivery — to provide you with the requested service.
  • Social features and user-to-user interactions — to facilitate following other users, viewing trading activity, sharing predictions, and engaging with the Pear community.
  • Respond to inquiries and offer support — to respond to your inquiries and solve any potential issues you might have.
  • Administrative information — to send you details about our products and services, changes to our terms and policies, and other similar information.
  • Fulfill and manage your orders — to fulfill and manage your orders, payments, returns, and exchanges made through the Services.
  • User-to-user communications — if you choose to use offerings that allow for communication with another user.
  • Request feedback — to request feedback and contact you about your use of our Services.
  • Protect our Services — including fraud monitoring and prevention.
  • Identify usage trends — to better understand how our Services are used so we can improve them.
  • Measure marketing effectiveness — to understand how to provide marketing and promotional campaigns most relevant to you.
  • Save or protect an individual's vital interest — when necessary, such as to prevent harm.
03 / Sharing

When and with whom do we share your information?

We may share your data with third-party vendors, service providers, contractors, or agents ("third parties") who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties, which are designed to help safeguard your personal information. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organization apart from us. They also commit to protect the data they hold on our behalf and to retain it for the period we instruct.

Public information through social features

When you use the social features of Pear, certain information may be shared publicly or with other users based on your account settings and activity:

  • Your profile information (username, display name, profile picture, bio)
  • Trading activity and positions you choose to make public
  • Users you follow and users who follow you
  • Content you post, share, or comment on within the Services
  • Your participation in leaderboards, competitions, or other social features

You can control the visibility of certain information through your privacy settings within the application.

04 / Third parties

What is our stance on third-party websites?

The Services may link to third-party websites, online services, or mobile applications and/or contain advertisements from third parties that are not affiliated with us and which may link to other websites, services, or applications. The Services may also include information obtained from third-party websites or sources, including prediction market platforms such as Polymarket, Kalshi, and other decentralized protocols.

Accordingly, we do not make any guarantee regarding any such third parties or their data, and we will not be liable for any loss or damage caused by the use of such third-party websites, services, or applications. The inclusion of a link towards (or presentation of data relating to) a third-party website, service, or application does not imply an endorsement by us. We cannot guarantee the safety and privacy of data you provide to any third parties.

Any data collected by third parties is not covered by this privacy notice. We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services, or applications that may be linked to or from the Services. You should review the policies of such third parties and contact them directly to respond to your questions.

Do we use cookies and other tracking technologies?

We may use cookies and similar tracking technologies (like web beacons and pixels) to access or store information.

Remembers preferences such as your theme, default sort, and onboarding progress.

Aggregate event tracking to measure feature usage and improve the product.
06 / Social logins

How do we handle your social logins?

Our Services offer you the ability to register and log in using your third-party social media account details or crypto wallet providers. Where you choose to do this, we will receive certain profile information about you from your social media provider or wallet service. The profile information we receive may vary depending on the social media provider or wallet service concerned, but will often include your name, email address, friends list, and profile picture, as well as other information you choose to make public on such a social media platform or wallet service.

We will use the information we receive only for the purposes that are described in this privacy notice or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party social media provider or wallet service. We recommend that you review their privacy notice to understand how they collect, use and share your personal information, and how you can set your privacy preferences on their sites and apps.

How do we keep your information safe?

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

Additional security considerations for crypto wallets

If you use our Services to create or manage a cryptocurrency wallet, you are solely responsible for maintaining the security of your private keys, seed phrases, and wallet credentials. We do not store your private keys or seed phrases on our servers. Loss of access to your private keys or seed phrases may result in permanent loss of access to your digital assets, and we cannot recover this information for you.

08 / Eligibility

Do we collect information from minors?

We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records.

09 / DNT

Controls for Do-Not-Track features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized.

As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

Do California residents have specific privacy rights?

If you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with the Services, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us using the contact information provided below and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g., backups, etc.).

Will your information be shared with anyone else?

We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. Each service provider is a for-profit entity that processes the information on our behalf, following the same strict privacy protection obligations mandated by the CCPA. We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be "selling" of your personal information.

Verification process

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. We will only use personal information provided in your request to verify your identity or authority to make the request. If we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

Exercising your rights under the Virginia CDPA

You may contact us by email at team@pear.trade. If you are using an authorized agent to exercise your rights, we may deny a request if the authorized agent does not submit proof that they have been validly authorized to act on your behalf.

Verification process

We may request that you provide additional information reasonably necessary to verify you and your consumer's request. If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request. Upon receiving your request, we will respond without undue delay, but in all cases, within forty-five (45) days of receipt. The response period may be extended once by forty-five (45) additional days when reasonably necessary. We will inform you of any such extension within the initial 45-day response period, together with the reason for the extension.

Right to appeal

If we decline to take action regarding your request, we will inform you of our decision and reasoning behind it. If you wish to appeal our decision, please email us at team@pear.trade. Within sixty (60) days of receipt of an appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may contact the Attorney General to submit a complaint.

Do we make updates to this notice?

We may update this privacy notice from time to time. The updated version will be indicated by an updated "Revised" date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy notice frequently to be informed of how we are protecting your information.
